Terms and Conditions of Sale

Preamble

The following provisions establish the general terms and conditions of sale (the "General Conditions") for products offered by Atelier Camille on its website www.ateliercamille.com (the "Site"). Atelier Camille is an SARL registered with the Paris RCS under number 807 394 457. Camille TEMPLIER is its manager. For the application of these terms, it is agreed that the user of the Site (the "User") and Atelier Camille will be collectively referred to as the "Parties" and individually as a "Party", and that the User who has placed an order will then be referred to as the "Buyer". The rights and obligations of the User necessarily apply to the Buyer. The User who wishes to purchase on the Site declares to have full legal capacity. Any order for a product offered on the Site implies consultation and express acceptance of the General Conditions, without this acceptance being conditioned by a handwritten signature of the User. In application of article 1369-5 of the civil code, the validation of the electronic contract is done according to the "double-click" principle by which the online buyer can check the details of their order and its total price in a first step to correct any errors, then confirm their order to express their acceptance.

Article 1. Purpose

These General Conditions aim to define, exclusively with regard to the relationships they establish on the Internet, the reciprocal rights and obligations of the Parties as well as the different stages of the ordering process. If a condition were to be missing, it would be considered governed by the customs in force in the distance selling sector for companies headquartered in France.

Article 2. Products

The products offered for sale by Atelier Camille (the "Products") are those listed on the website www.ateliercamille.com. The Products are described and presented with the greatest possible accuracy. The photographs and texts illustrating the Products attempt to describe their essential characteristics as accurately as possible. The Products comply with the regulations in force in France. Atelier Camille cannot be held liable in the event of non-compliance with the legislation of another country where the products are delivered; it is up to the Buyer to verify this. The Buyer is solely responsible for the choice of Products, their storage, and their use.

Article 3. Price

Prices are indicated in Euros, all taxes included, excluding customs duties and other taxes. Customs duties and other taxes must be paid by the Customer directly to the carrier. They take into account any reductions and VAT applicable on the day of the order. The prices indicated do not include shipping costs, which will be invoiced additionally and will be specified to the customer upon final validation of their order.

Offer and price validity period: prices are indicated for a period of 6 months, and Atelier Camille reserves the right to modify its prices, for example, during promotions or sales. Products will be invoiced based on the rates in effect at the time the order is placed. Products remain the property of Atelier Camille until full payment of the price. In the event of default of payment by the Buyer of all or part of the order price, Atelier Camille reserves, until full payment, a right of ownership over the sold products, allowing it to repossess said products by any means.

Article 4. Right of withdrawal – Refunds and returns

In accordance with Article L.221-18 of the Consumer Code, the non-professional Customer has a period of fourteen (14) days from the receipt of their Order to exercise their right of withdrawal with Atelier Camille.

The Customer can exercise their right of withdrawal from their customer area, in the "Orders" section, or by any other declaration expressing their wish to withdraw.

The right of withdrawal is exercised without penalty. Return shipping costs remain the responsibility of the Customer.

In accordance with Article L.221-21 of the Consumer Code, the Customer returns the Products without undue delay and at the latest within fourteen (14) days following the communication of their decision to withdraw.

After this period, the right of withdrawal can no longer be exercised.

The Product must be returned in its original condition, accompanied by its original packaging and all its possible accessories. Any depreciation resulting from handling other than that necessary to establish the nature, characteristics, and proper functioning of the Product may engage the Customer's liability.

To make a return from their customer area, the Customer can access the "Orders" tab and then select "Make a return."

The return of Products is at the Customer's expense and risk.

Atelier Camille will refund the Order no later than five (5) days from the date of receipt of the return at its offices.

Atelier Camille will make the refund using the same payment method as was used for the Order, unless the Customer expressly agrees for a different method to be used. Atelier Camille cannot be held responsible for refunds to an expired payment method.

The refund of an order paid with a gift card or credit note will automatically be refunded as a credit note.

Should the Customer fail to comply with these General Terms and Conditions of Sale, Atelier Camille will not be able to proceed with the refund of the Products concerned. In all cases, return shipping costs are borne by Atelier Camille if the Product delivered to the Customer is different from the ordered Product or if it is delivered damaged.
